1. Identity and address of the data controller
41PHAN3T (“41PHAN3T” or the “Controller”) — a variable-capital corporation (sociedad anónima de capital variable) per its tax-status certificate —, trading under the AlphaNetworks brand, with address at Guillermo González Camarena #1400, Álvaro Obregón, C.P. 01376, Mexico City, is responsible for the processing (collection, use, storage and protection) of your personal data, in accordance with this Privacy Notice (the “Notice”).
2. Legal framework
This Notice is issued in compliance with the Federal Law on the Protection of Personal Data Held by Private Parties, published in the Official Gazette of the Federation on 20 March 2025 and in force from 21 March 2025, last amended on 14 November 2025 (the “Law”), which repealed the 2010 law on the same subject, together with all other applicable provisions, including the Guidelines for the Privacy Notice. Please read this Notice carefully before providing your personal data.
3. Personal data we collect
The only personal data we collect is what you provide yourself through this site's contact form: full name, email address, telephone number (where given), the company or organisation you represent, and whatever information you include in the message field. The accuracy and truthfulness of the data provided is your responsibility. The site does not collect personal data by any other means; see section 11 on cookies and local storage for the technical detail of how the site works.
4. Sensitive and financial personal data
41PHAN3T does not collect or process sensitive personal data (ethnic origin, health, beliefs, preferences, union or political affiliation, and similar) nor financial or asset-related data. This site has no payment forms and does not request banking or card information.
5. Purposes of processing
A. Primary purposes (necessary for the relationship): a) to handle and follow up on the requests you make through the contact form; b) to answer questions and prepare commercial proposals regarding our operational continuity services (CareIT®, LeaseIT® and DiscoverIT®), according to your needs or those of the organisation you represent; c) to deliver, follow up on and assess the quality of the services and products requested.
B. Secondary purposes (not necessary, and requiring your consent): a) to send you information about our services, news, events or relevant content; b) to produce aggregate statistics and studies to better understand interest in our services and improve our offering; c) to personalise and improve the experience and content of the site.
Your consent to the secondary purposes is understood to be given tacitly if, after being made aware of this Notice, you do not state otherwise. If you do not wish your data to be processed for the secondary purposes, you may say so at any time by writing to contacto@alphanetworks.mx, without affecting financial or asset-related data (which, in any case, this site does not collect). Your refusal will not be grounds for denying you the services you request.
6. Options and means to limit the use or disclosure of your data
Besides opting out of the secondary purposes (section 5.B) and exercising your ARCO rights (section 10), you may register your phone number and email address with the Public Registry to Avoid Advertising (REPEP) maintained by Mexico's consumer protection agency (PROFECO), to stop receiving advertising from any supplier of goods or services, not only from AlphaNetworks. You may check the current procedure on PROFECO's official site.
7. Transfers
41PHAN3T will not transfer your personal data to third parties without your consent, except in the cases provided for by the Law. To operate the site and send the contact-confirmation email we rely on hosting and email-delivery providers acting as processors: they handle the data on behalf of and under the instructions of the Controller, which does not constitute a transfer within the meaning of the Law. If your data were ever to be processed for a purpose other than those described in this Notice, we will first ask for your consent to that new purpose.
8. Data retention
Your data will be kept for as long as necessary to fulfil the purposes described and the applicable legal obligations. It is stored in systems and files to which access is limited to the Controller, and is processed observing the principles of lawfulness, consent, information, quality, purpose, loyalty, proportionality and accountability set out in the Law.
9. Staff confidentiality
Everyone who, on behalf of 41PHAN3T, takes part in any stage of processing your personal data is bound to keep it confidential, an obligation that survives the end of their relationship with the Controller.
10. ARCO rights, timelines and withdrawal of consent
You have the right to Access your personal data, to Rectify it when it is inaccurate, to Cancel it when you consider it is no longer required and to Object to its processing (“ARCO” rights), as well as to withdraw your consent at any time, with no retroactive effect.
To exercise any of these rights or withdraw your consent, send your request to contacto@alphanetworks.mx or to our address, addressed to 41PHAN3T, enclosing: a) valid official identification of the data subject (and, where acting through a representative, the document evidencing that capacity); b) a clear description of the data over which you seek to exercise the right and of the right you wish to exercise; c) an address or email address at which we can send you our reply.
The Controller has a maximum of 20 business days from receipt of the request to notify you of the decision taken; where the request is upheld, it will be given effect within the following 15 business days. These periods may be extended once, for an equal period, when the circumstances of the case justify it. Access to your data is delivered as simple copies, electronic documents, or whichever means is most practical for the case, at no cost other than any shipping or reproduction expenses that may apply. Once cancellation has been carried out, we will notify you.

11. Cookies, local storage and tracking
This site does not use tracking cookies, web beacons, or third-party analytics or advertising tools (no Google Analytics, no Meta pixels, nothing similar). The only thing the site stores on your device is your light/dark theme preference, through the browser's local storage (localStorage): a technical, non-personal piece of data that is never transmitted to our servers and that you may delete at any time from your browser settings.
As with any website, our hosting provider technically and transiently processes connection data (such as your IP address) solely to deliver pages to you securely and detect abuse; we do not use it to build profiles or for advertising purposes.
12. Competent authority
If you believe your right to the protection of personal data has been infringed, you may approach the competent authority. Following the 2025 reform, the powers of the former National Institute for Transparency, Access to Information and Protection of Personal Data (INAI) were assumed by the Ministry of Anti-Corruption and Good Governance of the Federal Government.
13. Changes to this Privacy Notice
The Controller may amend this Notice at any time to reflect legislative, internal or service-related developments — including, in due course, the addition of further contact channels such as WhatsApp or other networks, with their own section on how that data is handled. Any amendments will be made available on this same site, with the corresponding update date.

By providing your personal data through this site and/or the contact form, you declare that you have read, understood and accepted the terms of this Privacy Notice.
